Pasal 1 ayat (1) UUD 1945 menyatakan bahwa bentuk negara Indonesia adalah negara kesatuan (unitary state), bukan negara federal. Tetapi pada Pasal 18, Pasal 18A, dan Pasal 18B terdapat pengaturan desentralisasi dan otonomi daerah yang mencerminkan ciri dan prinsip-prinsip negara federal. Hal ini seolah-olah memberi makna bahwa Negara Republik Indonesia merupakan negara dengan sistem kesatuan hanya secara de jure.
